CAUSES OF THE SEXUAL REVOLUTION: LEGAL DECISIONS
The post World War II period was a time of change in many ways, of course, other than sexual. A number of historical legal decisions were enacted in the fifties and sixties that dramatically transformed American values and affected the lives of all of us in a variety of ways. In particular, several Supreme Court decisions were reached that had a profound influence on American sexuality and that contributed to the sexual revolution. Although these events are described in more detail in subsequent chapters, their importance as both causes and effects of the sexual revolution is discussed here.
The first of these issues, pornography, produced several Supreme Court decisions, dating from 1957 to 1973. These decisions were essentially attempts to resolve the apparent conflict between the First Amendment's guarantees of freedom of speech, on the one hand, and the various State laws prohibiting the sale and distribution of pornographic material, on the other. Although the many complex issues related to this question still have not been resolved, the practical effect of the Court's decisions has been a greater availability of pornographic material to the general public with a reduced risk of criminal conviction on the part of the vendor. Most communities, for example, now tolerate X-rated movie houses and "porno shops" as long as they meet whatever the local requirements may be. Moreover, mailorder houses for sales of pornographic material operate with little risk of intervention on the part of the postal authorities.
